1. About these Terms

These Terms and Conditions govern your access to and use of this website, and the purchase of products from RIVOX (“we”, “us”, “our”).

By accessing this website, placing an order, or purchasing any product from us, you agree to be bound by these Terms and Conditions, together with our Privacy Policy, Shipping Policy, Returns and Refunds Policy, and Warranty Policy.

If you do not agree, you must not use this website or place an order.

2. Business Information

RIVOX sells electric scooters, electric bikes, accessories and related products to customers in Australia.

We may update these Terms and Conditions from time to time. The version published on our website at the time of your order will apply to that order.

3. Orders

All orders are subject to acceptance and availability.

We may refuse, cancel or limit any order at our discretion, including where:

  • a product is unavailable,
  • there is an error in pricing or product information,
  • we suspect fraud, misuse, or unlawful conduct, or
  • the order cannot be fulfilled for commercial, compliance, safety or legal reasons.

If we cancel an order after payment has been received, we will refund the amount paid in accordance with Australian Consumer Law.

4. Product Information

We try to ensure all product descriptions, photographs, specifications and pricing are accurate. However, images are for illustration only and may differ slightly from the final product.

Unless expressly stated otherwise, any performance figures, range estimates, battery life, top speed, climbing capacity and charging times are approximate only and may vary depending on rider weight, terrain, road conditions, weather, maintenance, tyre pressure, riding style and battery condition.

Customers must not rely solely on promotional material when determining whether a product is suitable for their intended use.

5. Legal Use of Products

The buyer is responsible for ensuring that the purchase, registration, operation and use of any product complies with all laws, regulations and local requirements applicable in the buyer’s State or Territory, including road, transport, registration, helmet, age, public path and private property rules.

We do not warrant that every product sold on this website is permitted for public road, footpath, bicycle lane, shared path or other public area use in every Australian jurisdiction.

Where a product is described as:

  • off-road only,
  • private property use only,
  • not road legal, or
  • subject to State-based restrictions,

the buyer acknowledges that the product may be restricted or prohibited from use in public places and must only be used lawfully.

The buyer must carefully read the product listing and all warnings before purchase and use.

6. Buyer Acknowledgement for Restricted-Use Products

For any product identified on the product page, packaging, invoice, order confirmation or manual as restricted, off-road, private property only, or otherwise limited in lawful public use, the buyer acknowledges and agrees that:

a. the product may not be legal for public road or path use in Victoria or other Australian jurisdictions;
b. the product may only be used in a lawful manner and in lawful locations;
c. it is the buyer’s responsibility to check and comply with local laws before use;
d. unlawful use, modification, derestriction or operation is entirely at the buyer’s own risk; and
e. RIVOX is not responsible for fines, penalties, confiscation, infringement notices, loss, damage or claims arising from unlawful use by the buyer or any third party.

7. Pricing and Payment

All prices are listed in Australian dollars unless otherwise stated.

Prices may include GST where applicable. Shipping, insurance, assembly, delivery surcharges or other charges may be shown separately at checkout.

We reserve the right to change prices at any time before an order is placed.

Payment must be received in full before dispatch unless otherwise agreed in writing.

8. Shipping, Delivery and Title

Delivery dates are estimates only. We are not liable for delays caused by freight carriers, customs, port congestion, weather events, supply chain issues, or other events outside our reasonable control.

Risk in the product passes to the buyer upon delivery to the nominated address, or upon collection if the buyer collects the item.

Title to the goods passes only when full payment has cleared.

The buyer must inspect goods promptly upon delivery and notify us within a reasonable time if there is visible damage, shortage or delivery error.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law where such rights cannot lawfully be excluded.

Where goods are supplied to a consumer, they come with guarantees that cannot be excluded under Australian Consumer Law. You may be entitled to a replacement, repair or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You may also be entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

10. Supplier and Manufacturer Warranty

In addition to any rights under Australian Consumer Law, certain products may include manufacturer-backed or upstream supplier-backed warranty support.

Where applicable, warranty support may include:

a. a 12-month warranty for core parts including the motor, controller, charger, display, throttle and battery;
b. other parts are generally not covered unless there is a confirmed batch failure or manufacturing issue;
c. for approved warranty claims, warranty spare parts shipping fees may be paid by RIVOX;
d. human damage, misuse, accidental damage, unauthorised modification or improper use are not covered;
e. customers must provide clear videos or photos of the defective product to support assessment;
f. after-sales assessment may include review by technicians, engineers, the manufacturer or an upstream supplier to determine whether the issue is related to manufacturing, materials or another cause; and
g. if the claim is accepted, warranty spare parts, troubleshooting support, remote technical support, repair guidance, or another appropriate remedy may be provided.

Any manufacturer or supplier-backed warranty support is subject to assessment, availability of parts, and the applicable warranty process. RIVOX does not guarantee that any manufacturer or upstream supplier will approve every claim or provide every requested part.

Nothing in this clause limits or excludes any rights or remedies that cannot be excluded under the Australian Consumer Law.

11. Warranty Exclusions

To the maximum extent permitted by law, warranty claims may be refused where damage or failure arises from:

a. misuse, abuse, neglect or accident;
b. unlawful riding or use in prohibited areas;
c. racing, commercial hire, stunt riding, overloading or off-label use;
d. improper charging, storage, battery neglect or water damage;
e. failure to follow manuals, safety instructions or maintenance requirements;
f. normal wear and tear, including tyres, tubes, brake pads, cosmetic marks and consumables;
g. unauthorised repair, disassembly, rewiring, modification, derestriction or tampering;
h. use of incompatible chargers, batteries or accessories; or
i. damage caused by transport, third parties or external events after delivery.

12. Warranty Claim Process

To make a warranty claim, the customer must contact us at info@rivox.com.au and provide:

  • proof of purchase,
  • order number,
  • description of the fault,
  • clear photos and/or video showing the issue,
  • serial number where available, and
  • any other information reasonably requested for assessment.

We may require troubleshooting steps to be completed before approving any repair, replacement or spare part request.

Where a fault is minor, we may choose to repair, replace or provide spare parts, subject to Australian Consumer Law.

Where a claim is not covered under warranty or ACL, the customer may still request paid repairs, spare parts or service support where available.

13. Returns and Refunds

Our Returns and Refunds Policy forms part of these Terms.

Change-of-mind returns are only accepted where expressly stated in our Returns Policy. Approved change-of-mind returns may be subject to conditions, including the item being unused, unopened, in original packaging, and returned at the customer’s cost.

We do not accept change-of-mind returns for products that have been ridden, assembled, used, modified, damaged after delivery, or specially ordered, unless required by law.

Refunds, repairs and replacements for faulty products will be handled in accordance with Australian Consumer Law.

14. Product Safety and Battery Handling

Electric scooters, e-bikes and lithium battery products must be used with care.

The buyer must:

  • follow the product manual and all safety instructions,
  • use only approved or supplied chargers,
  • supervise charging where appropriate,
  • avoid overcharging, impact damage, puncture, heat exposure and water intrusion,
  • keep batteries away from flammable materials, and
  • stop using the product immediately if there is smoke, swelling, overheating, unusual odour, sparking or visible battery damage.

Improper charging, storage or battery handling may result in fire, serious injury, death or property damage.

15. Repairs, Modifications and Derestriction

The buyer must not modify, derestrict, reprogram, rewire, upgrade, tune or alter the speed, motor output, battery, controller, brakes or any safety system unless expressly authorised in writing by the manufacturer and permitted by law.

Any unauthorised modification may:

  • make the product unsafe,
  • void warranty coverage,
  • affect insurance,
  • breach road rules or product safety laws, and
  • make the product unsuitable for lawful use.

RIVOX is not liable for any loss, injury, damage, fine or claim arising from unauthorised modification or unlawful use.

16. Limitation of Liability

To the maximum extent permitted by law, and subject always to Australian Consumer Law, RIVOX excludes all liability for indirect, incidental, special or consequential loss, including loss of profit, loss of opportunity, loss of goodwill, business interruption or data loss.

RIVOX’s total liability in connection with any claim relating to goods supplied by us is limited, at our option and to the extent permitted by law, to:

  • repair of the goods,
  • replacement of the goods,
  • supply of equivalent goods,
  • payment of the cost of repair or replacement, or
  • refund of the purchase price.

Nothing in these Terms limits liability that cannot be excluded by law.

17. Buyer Responsibility and Indemnity

The buyer is responsible for ensuring that any person using the product is competent, properly supervised where required, wears appropriate protective equipment, and uses the product lawfully and safely.

The buyer agrees to indemnify and hold RIVOX harmless, to the extent permitted by law, from claims, penalties, losses, costs or liabilities arising from:

  • unlawful use of the product,
  • use contrary to our warnings or instructions,
  • unauthorised modification,
  • negligent, reckless or unsafe operation, or
  • use by third parties to whom the buyer provides the product.

This clause does not apply to the extent a loss is caused by our own breach of law or non-excludable statutory obligations.

18. Intellectual Property

All website content, including text, graphics, logos, product descriptions, images and layout, is owned by or licensed to RIVOX and must not be copied, reproduced or used without prior written consent.

19. Privacy

Your use of this website and any purchase made through it is also governed by our Privacy Policy.

20. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any dispute arising out of or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of Victoria.
